ECOPERKS PROGRAM RULES
These EcoPerks Program Rules govern the earning, recording, holding, movement, use, expiry, reversal, and Redemption of EcoPerks. These rules operate together with the Terms and Conditions, Travel Redemption Terms, Affiliate Terms and Conditions where relevant, and any campaign or partner-specific conditions published by EcoForce Global Australia.
Definitions
Member means a natural person or entity that holds a current EcoPerks membership in accordance with the Terms and Conditions. Affiliate means a Member or other approved person or entity authorised by EcoForce Global Australia to participate in the EcoForce Global Australia affiliate program under the Affiliate Terms and Conditions. EcoPerks means promotional loyalty points recorded by EcoForce Global Australia under the EcoPerks Program Rules. EcoPerks are not cash, are not legal tender, do not constitute property, are not held on trust for a Member, are not redeemable except as expressly permitted by EcoForce Global Australia, and do not create a vested right. Redemption means the authorised use of eligible EcoPerks, whether alone or together with money, credits, fees, taxes, charges, or other consideration, to obtain travel, travel-related services, rewards, benefits, charitable allocations, or other approved program outcomes through EcoForce Global Australia or its authorised partners. Approved Charity means a charity, deductible gift recipient, not-for-profit organisation, community organisation, appeal, campaign, or other cause that EcoForce Global Australia has expressly approved for participation in a EcoPerks donation, allocation, or support feature. Unless the context requires otherwise, references to EcoForce Global Australia, we, us, or our mean EcoForce Global Australia Pty Ltd and its related bodies corporate, successors, assigns, authorised operators, and service providers involved in the relevant program, booking, campaign, or platform function.
Related Documents and Cross-References
These EcoPerks Program Rules apply specifically to the earning, holding, allocation, gifting, pooling, donation, reversal, expiry, and Redemption of EcoPerks. They operate together with the Terms and Conditions, the Affiliate Terms and Conditions where relevant, the Travel Redemption Terms, the Website Disclaimer, and any campaign-specific or partner-specific conditions published by EcoForce Global Australia from time to time. For convenience and interpretation, references in this legal suite should be read consistently as follows: the Terms and Conditions contain the general membership, platform, billing, conduct, privacy, and liability framework; the Affiliate Terms and Conditions contain the specific rules for Affiliate approval, marketing, compensation, and compliance; the EcoPerks Program Rules contain the detailed rules for the earning, posting, expiry, reversal, gifting, pooling, donation, allocation, and use of EcoPerks; the Travel Redemption Terms contain the detailed rules for bookings, itineraries, taxes, fees, changes, cancellations, refunds, supplier conditions, and all travel and travel-related Redemptions; and the Website Disclaimer clarifies the limited informational status of website and promotional content and does not create additional contractual rights beyond the applicable operative terms. Unless EcoForce Global Australia expressly states otherwise in writing for a particular feature, booking, campaign, or partner arrangement, the following order of precedence applies where there is any inconsistency: first, any mandatory law that cannot be excluded; second, any supplier-specific, booking-specific, campaign-specific, or feature-specific terms stated to apply to the relevant transaction or feature; third, the Travel Redemption Terms for travel and travel-related Redemptions; fourth, the EcoPerks Program Rules for all matters concerning EcoPerks; fifth, the Affiliate Terms and Conditions for all matters concerning Affiliate participation, conduct, qualification, and compensation; sixth, the Terms and Conditions as the general membership and platform framework; and seventh, the Website Disclaimer, which is informational only and does not override any transactional or program-specific terms. Where these documents refer to each other, that reference is intended to incorporate the relevant document as amended from time to time, except to the extent prohibited by law. A reference to a document includes any replacement document or renamed equivalent published by EcoForce Global Australia for substantially the same subject matter.
Status of EcoPerks
EcoPerks are promotional loyalty points recorded by EcoForce Global Australia for program purposes only. EcoPerks are not cash, are not legal tender, do not constitute property, are not held on trust for a Member, are not redeemable except as expressly permitted by EcoForce Global Australia, and may be varied, restricted, cancelled, expired, reversed, or withdrawn in accordance with these rules.
Eligibility, Active Paid Status, and Good Standing
A Member may earn, hold, receive, gift, pool, donate, allocate, or redeem EcoPerks only while the relevant account is active, verified where required, compliant with the governing terms, and maintains an active monthly membership subscription in good standing, unless EcoForce Global Australia expressly permits a specific exception in writing. EcoForce Global Australia may restrict certain categories of EcoPerks or certain features by country, membership type, affiliate status, campaign, supplier, or account condition. A Member who purchases or maintains a monthly membership subscription must be at least 18 years of age and must have the legal capacity and authority to agree to the governing terms and to authorise recurring charges to the nominated payment method.
Monthly Membership Subscription, Billing Authority, Cancellation, and Payment Failure
EcoForce Global Australia currently offers monthly membership subscriptions only unless EcoForce Global Australia expressly introduces another plan in writing. A Member who purchases or continues a monthly membership subscription authorises EcoForce Global Australia and its payment processors to charge the nominated payment method on the applicable billing date for the monthly subscription fee and any other amounts properly payable under the governing terms, and to continue doing so on a recurring monthly basis unless the subscription is cancelled before the next billing date. A cancellation request stops future renewals only and takes effect at the end of the already-paid monthly subscription period, unless EcoForce Global Australia expressly agrees otherwise in writing or applicable law requires a different outcome. Subscription fees are non-refundable for change of mind, partial use, non-use, early cancellation, or failure to use available membership benefits, except to the extent required by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. If a subscription payment is not successfully received on the billing date for any reason, including payment failure, chargeback, reversal, expired payment details, insufficient funds, or a failure by the Member to keep payment details current, EcoForce Global Australia may suspend the membership account and the Member will not be entitled to use suspended subscription benefits or suspended EcoPerks features during the suspension period. If the overdue subscription amount is paid before the end of the relevant calendar month, EcoForce Global Australia may reactivate the account for future participation, but the original recurring billing date remains unchanged unless EcoForce Global Australia expressly notifies otherwise in writing. If the overdue subscription amount is not successfully received by the end of the relevant calendar month, EcoForce Global Australia may cancel the monthly membership subscription, require the Member to reactivate through a new purchase process, and refuse to reinstate forfeited rights for the unpaid month.
How EcoPerks May Be Earned
EcoPerks may be awarded for eligible membership payments, approved merchant purchases, approved travel bookings, referrals, promotional campaigns, bonuses, engagement actions, community activities, or other qualifying activities designated by EcoForce Global Australia from time to time. EcoForce Global Australia may set different earn rates, exclusions, thresholds, pending periods, campaign windows, and category limitations for different types of activity. Unless EcoForce Global Australia expressly states otherwise for a particular campaign or category, a Member is not entitled to retain EcoPerks for a month in which the Memberβs monthly membership subscription payment is not successfully received by the end of the calendar month in which that payment was due.
Pending Points and Posting
EcoPerks may appear as pending, estimated, provisional, or unconfirmed until the relevant activity has been validated, cleared, paid, confirmed by a partner, or otherwise accepted by EcoForce Global Australia. Pending points may not be gifted, pooled, donated, allocated, or used for Redemption unless and until they become available and are recorded as eligible in the relevant account.
Promotional, Bonus, and Restricted Points
EcoForce Global Australia may issue promotional points, bonus points, campaign points, goodwill credits, manual adjustments, or other special categories of EcoPerks. EcoForce Global Australia may determine that some categories of EcoPerks have different expiry dates, transfer rights, pooling rights, donation rights, Redemption rights, or no movement rights at all. Unless expressly stated otherwise, promotional and bonus points may be more heavily restricted than base-earned points.
Excluded and Invalid Activity
EcoPerks will not be earned, and may be reversed if previously credited, where the relevant activity involves a refund, chargeback, cancellation, self-referral, duplicate account, false identity, sham transaction, policy breach, unauthorised conduct, ineligible booking, system error, partner rejection, or any activity that EcoForce Global Australia reasonably considers invalid, abusive, or inconsistent with the genuine purpose of the program.
Balances, Statements, and Errors
A Member is responsible for reviewing the balance and transaction history shown in their account and for promptly notifying EcoForce Global Australia of any suspected discrepancy. EcoForce Global Australia may correct clerical, systems, pricing, campaign, posting, transfer, or Redemption errors at any time, whether or not the error benefited the Member. A displayed balance, illustrative value, or estimated Redemption outcome does not prevent EcoForce Global Australia from later correcting the account in accordance with the true program position.
Expiry of EcoPerks
Unless EcoForce Global Australia expressly states otherwise for a particular category of EcoPerks or campaign, EcoPerks expire two years after the Memberβs last earned point activity. For this purpose, last earned point activity means the successful crediting of new eligible EcoPerks to the Memberβs account from an approved qualifying earn event recognised by EcoForce Global Australia and does not include merely receiving gifted points, moving points within a Family Pool, making a donation, having points recredited after a reversal, or any other activity that EcoForce Global Australia designates as non-earning activity. Expired EcoPerks are automatically cancelled and cannot be reinstated except where EcoForce Global Australia chooses to do so in its discretion.
Reversals, Deductions, Negative Balances, and Month-End Forfeiture
If EcoPerks were credited in connection with a transaction or activity that is later refunded, reversed, cancelled, disputed, charged back, found to be ineligible, or otherwise invalid, EcoForce Global Australia may deduct those points from the relevant account, Family Pool, campaign balance, receiving account, or redeeming account. If sufficient EcoPerks are not available at the time of deduction, EcoForce Global Australia may place the account into a negative balance and offset future earned points, future credits, commission entitlements, or other amounts otherwise payable or available to the Member or Affiliate. If a monthly membership subscription payment is not successfully received by the end of the calendar month in which that payment was due, all EcoPerks, commissions, bonuses, incentives, and other point-based or affiliate entitlements for that month may be withheld, cancelled, reversed, or forfeited in full, even if the overdue subscription amount is later paid.
General Redemption Framework
A Redemption may only be made through authorised EcoForce Global Australia channels and only in respect of eligible EcoPerks, eligible accounts, and available categories determined by EcoForce Global Australia from time to time. EcoForce Global Australia may set minimum thresholds, category restrictions, approval conditions, fees, taxes, charges, identity checks, booking controls, beneficiary conditions, and supplier requirements that apply to a Redemption. Where EcoForce Global Australia expressly permits it for a particular Redemption, taxes, fees, charges, and other travel-related amounts may be paid in whole or in part using EcoPerks. A Redemption request does not become binding until accepted and processed by EcoForce Global Australia or the authorised partner.
Gifting of EcoPerks
Where made available by EcoForce Global Australia, eligible Members may gift eligible EcoPerks to another approved Member through authorised EcoForce Global Australia channels only. Any gifting feature is subject to minimum and maximum thresholds, account eligibility criteria, receiving account eligibility, verification requirements, frequency limits, and campaign exclusions set by EcoForce Global Australia from time to time. Unless EcoForce Global Australia expressly states otherwise, gifted EcoPerks retain the conditions, restrictions, expiry treatment, and reversal risk attaching to those points at the time they were originally earned or issued.
Family Pool Arrangements
Where made available by EcoForce Global Australia, eligible Members may participate in a Family Pool in accordance with the requirements published by EcoForce Global Australia from time to time. EcoForce Global Australia may require proof of relationship, household confirmation, identity verification, minimum account age, linked account approval, and any other evidence it considers appropriate before permitting a Member to join or remain in a Family Pool. EcoForce Global Australia may determine who may create, manage, contribute to, access, or redeem from a Family Pool and may impose limits on participating Members, points categories, exit rules, and Redemption rights.
Donations to an Approved Charity
Where made available by EcoForce Global Australia, eligible Members may allocate or donate eligible EcoPerks to an Approved Charity through authorised EcoForce Global Australia channels and subject to the applicable minimum thresholds, conversion methodology, campaign rules, verification procedures, and closing dates published by EcoForce Global Australia from time to time. Unless EcoForce Global Australia expressly states otherwise, a donation of EcoPerks is irrevocable once processed, is not redeemable for cash by the donating Member, and does not create any ownership, repayment, refund, or recredit right in the Member in relation to the donated points or the value attributed to them.
Local Cause and Hardship Campaigns
EcoForce Global Australia may make available approved community support campaigns, local cause campaigns, member hardship appeals, disaster relief campaigns, or similar point allocation features through which eligible Members may contribute eligible EcoPerks to designated recipients or causes approved by EcoForce Global Australia. Any such contribution must occur only through the authorised platform process and remains subject to all campaign conditions, recipient approval requirements, verification steps, fraud controls, expiry rules, limits, and eligibility rules determined by EcoForce Global Australia. Members have no right to create private point markets, off-platform point arrangements, informal swaps, or direct personal transfer arrangements outside the authorised process.
Restrictions on Sale and Private Dealing
Except where expressly authorised by EcoForce Global Australia under these rules, EcoPerks may not be sold, bought, bartered, pledged, assigned, traded, auctioned, privately transferred, or otherwise dealt with for value or for informal consideration. Any attempted dealing in breach of this rule is void to the fullest extent permitted by law and may result in cancellation of points, suspension of accounts, cancellation of Redemptions, or termination from the program.
Fraud, Verification, and Audit Rights
EcoForce Global Australia may require identity verification, account verification, source of funds checks, proof of transaction, proof of relationship, beneficiary confirmation, household confirmation, campaign substantiation, or other information before allowing the earning, movement, donation, pooling, gifting, or Redemption of EcoPerks. EcoForce Global Australia may investigate, pause, refuse, reverse, or cancel any points activity where it suspects fraud, system abuse, artificial behaviour, commercial dealing, false identity, account farming, coercion, collusion, or any breach of these rules.
Suspension, Forfeiture, and Program Changes
EcoForce Global Australia may suspend or terminate participation in the EcoPerks program, freeze balances, cancel or forfeit points, or withdraw a points feature if a Member breaches the governing terms, fails verification, becomes inactive, dies, is subject to legal restriction, or where suspension is reasonably necessary for fraud prevention, supplier protection, systems integrity, operational change, or regulatory compliance. EcoForce Global Australia may amend earn rates, expiry rules, categories, partner participation, transfer rights, donation rights, pooling rights, Redemption options, or any other part of the program from time to time, subject to applicable law. Where a change will have, in our reasonable opinion, a material detrimental impact on current subscription-related points benefits, EcoForce Global Australia will give prior notice where required by law.
Governing Law
These terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland, Australia, except to the extent mandatory law in another jurisdiction applies and cannot lawfully be excluded.
